Terms and conditions of use

General terms

Definitions
The following definitions apply in these terms and conditions

  • Terms – means the terms and conditions set out below that apply to the use of this web site.
  • Web site – means the URL www.publicjobsdirect.com which is owned and operated by Public Jobs Direct Limited.
  • PJD – means Public Jobs Direct Limited and any PJD affiliate.
  • Use – means use of this Web site or third party web sites links through access, navigation, search, registration, contract, agreement, display, contact, copy, download, transmittal or distribution of any content.  
  • Employment – means the employment or engagement of a job seeker on a permanent or temporary basis whether under a contract of employment, contract of or for service, any agency, licence or franchise or partnership agreement or any other arrangement. 
  • Job seeker – means a person who is seeking employment including those who seek to provide their services through a third party limited, umbrella or composite company.    
  • Employer & Recruiter – means a local authority, business, firm, organization, corporate body, registered charity or person who advertises job opportunities on the Web site.
  • Third party – means any job seeker, recruiter or other party than PJD who uses the Web site and any third party website links.

References to the singular include the plural and references to the masculine include the feminine and vice versa.
 
Reference to any party shall be deemed to be reference to or include its successors in title and permitted transferees and/or assignees.
 
All references to 'us' or 'we' refers to www.publicjobsdirect.com and PJD.
 
All references to ‘you’ or ‘your’ means the third party.

Use of the Web site means your acceptance of the terms which may be amended from time to time and your continued use means your acceptance of any amended terms.   
 
Privacy
Public Jobs Direct (PJD) is committed to protecting your confidentiality and is registered with the Information Commissioner's Office, the UK's independent public body set up to promote access to official information and to protect personal information. They regulate and enforce the Data Protection Act, the Freedom of Information Act, the Privacy and Electronic Communications Regulations and the Environmental Information Regulations.

Web site purpose
The Web site is for use by job seekers, employers and recruiters for the purpose of advertising and seeking employment opportunities and employment information in the UK Public Sector and for third party organizations advertising services to users.
 
Web site content and disclaimers
The Web site content is specific to its purpose and you are free to use it in this context. You are not permitted to use any of its content for any other purpose.
 
The content is from two source categories;

  1. PJD and any PJD affiliate (PJD content)
  2. Third parties (third party content)

PJD content to the best of our knowledge is complete and accurate on the date it is displayed on the Web site.
 
Third party content is displayed on the basis that the third party warrants to PJD that it is complete and accurate on the date they submit it to us.
 
Whilst we make every reasonable effort to ensure and maintain the completeness and accuracy of the Web site content, we disclaim ourselves from any duty or obligation thereunder.
 
The Web site contains links to third party web sites which are provided for information purposes only. We are not responsible for any of their content and disclaim ourselves from all liability for any demand, loss or damage suffered by you from the use of these web sites.
 
Any advice or articles displayed on the Web site should not be regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice or information to other certified codes of practice. You should always seek professional advice independently from a qualified source.
 
PJD excludes to the fullest extent permitted by law, all warranties, whether express or implied, including warranties in respect of quality or fitness for any particular purpose of any information content on the Web site.
 
Whilst we make every reasonable effort to ensure the Web site is free from computer viruses and other harmful devices (harmful devices) you use the Web site at your own risk. We disclaim ourselves from all liability for any loss or damage suffered by you from downloading any harmful devices from the Web site.

Web site service
The Web site service is reliant upon the stability of its information technology (IT) systems and the Internet. It operates on a powerful and secure server using the latest technology in web hosting solutions. Whilst we make every effort to ensure the stability of our systems, access to the Web site may occasionally suffer through IT or Internet failure. The Web site may also be subject at certain times to system and design updates. We will accept no responsibility or liability for any delay, damage or loss you may suffer as a result of the Web site not being accessible at all times.

Copyright and trademarks
All copyright, database rights, intellectual property rights and material content of the Web site including its design belong to PJD and all rights are reserved accordingly.
 
PJD and its devices are registered trademarks of PJD and visitors may not use such trademarks without the prior written permission of PJD.
 
The same rule applies to any third party trademarks displayed on the Web site except that prior written permission must be obtained from the third party.

We take all complaints seriously and it is our aim to resolve them on the day that they are received. Where the nature of the complaint can’t be satisfied the same day, we will advise you of the estimated resolution time. We would normally expect to resolve complaints within 7 days.  
 
Law
These terms are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the Courts of England and Wales.
 
For convenience these terms may be translated into languages other than English but in the event of a dispute over their interpretation the English version will predominate over any translation.

About recruiters
Recruiter profiles contain their company and contact information. How we collect and use that information is explained in our recruiter privacy policy. 
 
Job vacancies advertised on the Web site are written and posted directly by the recruiters.
 
We do not warrant the accuracy or completeness of recruiter profiles or their job vacancies and accept no responsibility or liability thereof. It is your responsibility to validate this information.
 
We do uphold the values of diversity and will act upon complaints concerning any unlawful discrimination against job seekers advertised in recruiter profiles and job vacancies. Click here to view our job seeker diversity policy.

About job seekers
Job seeker profiles contain their personal information such as CV, bio data, education and employment history and contact details. How we collect and use that information is governed by the Data Protection Act and our job seeker privacy policy. 
 
We do not warrant the accuracy or completeness of job seeker profiles and accept no responsibility or liability thereof. It is your responsibility to validate this information according to your recruitment, selection and employment procedures.
 
Advertising
 
Registration

To commence advertising services on the Web site you must first register as an Employer or Recruiter. If you have not already registered please click here to start the process.
 
Upon receipt of your registration details we will process your application and subject to our approval we will confirm your recruiter log in access codes.
 
We reserve the right at our discretion to decline your registration without giving a reason.
 
Log in
Upon log in you will have access to your recruiter profile through which you can advertise job vacancies and administer job seeker response.  
 
You can enhance your recruiter profile through a pay for advertising product (see below) where job seekers can view more information about your company other than a job vacancy.
 
Products
You can advertise your job vacancies free on the Web site together with free job alert to those job seekers who choose to be notified.
 
You will also have free access to ‘Response Manager’, an online database tool for administering job seeker response. 
 
You can purchase a range of pay for advertising products to raise your profile to job seekers such as
 

  • Logo on job vacancy
  • Banner advert
  • Button advert
  • Recruiter profile
  • Micro-site standard
  • Micro-site advanced
  • Micro-site bespoke
  • Online application form

You agree that we may re-advertise the job vacancies you post on the Web site with appropriate third party web sites with which we have advertising agreements. Such links will be at our sole discretion and you will not be charged extra for this service. This should not be confused with any campaigns you might order from us that include advertising on the Web site and selected other web sites. This service would be a pay for option.
 
Employers & Recruiters code of advertising conduct
You warrant that the information you advertise on the Web site including any third party web site links, is accurate, complete, not offensive, not discriminating, is legally compliant and for the purpose intended. You further warrant that you have the necessary permissions to advertise the information in the public domain.
 
If you are an employment agency or employment agency business you warrant that your advertising is compliant with the Conduct of Employment Agencies and Employment Agency Business Regulations 2003. 
 
Your advertisement should contain

  1. Brief description about the employer
  2. Employment type i.e., permanent or temporary, full or part time
  3. Start date (particularly if you have a deadline)
  4. Accurate and relevant job description
  5. Minimum qualifications and skills
  6. Criminal Record Bureau (CRB) disclosure (if required)
  7. Job location
  8. Salary or range
  9. Additional benefits
  10. Working hours
  11. Check written content for misspelling and grammar

Your advertisement must not contain

  1. Abusive or foul language
  2. Unlawful or unfair discrimination on the grounds of; gender, gender reassignment, sexual orientation, marital status, race or cultural origin, nationality, religion or belief, disability, age or ex-offender status. Click here to view our employers & recruiters’ diversity policy for guidance.
  3. Deliberate repeating of key search words, strings and phrases for the express purpose of gaining an unfair advantage in the ranking of your job vacancies through job searches. We do allow each vacancy posted to have up to 10 key search words in a specified box when you place your advert.
  4. Web site or email links or reference to such links in any of the descriptive text fields.

You further agree not to

  1. Replicate the job vacancies of other employers & recruiters on the Web site, except where you are one of a number of recruiters, recruiting job seekers for the same job for a direct employer and with the express permission of that direct employer. In that context you agree not to replicate another recruiter’s advert except for copying the information supplied to you by the direct employer.
  2. Use advertising for any other purpose than the recruitment of job seekers, except where you are a third party advertising other services to users on the Web site with our express permission.
     

We will remove from the Web site any advertising information that we find to be in breech either of this code of conduct or the terms of the Web site.   
 
You agree to treat all job seekers who respond to your advertising professionally and fairly. We reserve the right to decline advertising from recruiters who we find do not follow codes of good recruitment practice such as those guidelines at the following links;      
 

By advertising on the Web site you agree to indemnify PJD against any claim made against us by an injured third party resulting from either your breech of this code of conduct or the terms of the Web site.
 
Job vacancy posting
You post your job vacancies online through your log in and choose the date you want each advert to appear on the web site.
 
Each job vacancy has a unique ID number and will be advertised on the Web site for a maximum of 28 continuous / inclusive days (advert period) after which they will automatically be removed from the Web site.
 
You can remove job vacancies from the Web site before the end of the advert period through your log in e.g., those jobs that are filled.
 
You will receive an order confirmation from us for each vacancy that you post to the Web site including a re-advert.    
 
If a job vacancy remains not filled at the end of the advert period it may be re-advertised (re-advert) for a further advert period and so on. You have to reactivate the vacancy through your log in otherwise it will not be displayed. The re-advert will retain the same ID number.
 
Adverts that do not contain any ‘pay for advertising products (product) such as logos, are free to advertise and re-advertise.
 
Where the job vacancy contains a product, you will be charged according to our rate card prices per advert period.   
 
Pay for advertising
Please click here to see our list of products which you may purchase according to our rate card prices and periods (product period). Prices, product periods and timings will be those prevailing at the time we confirm your order.
 
Certain products are subject to availability through high demand and may be subject to a waiting list or limited availability. You should therefore plan your advertising with us in advance so as not to be disappointed.

You will receive an order confirmation from us with a unique ID number for each product that you purchase. The order will set out the terms of order including, the product details, prices (excluding VAT), product period and any special terms or conditions that apply to the order.
 
Products purchased are valid for the agreed product period only. This includes products purchased in advance. Products not used within the product period will not be subject to extension or refund, except where a delay in using the product has been caused by us or we have agreed in writing to extend the product period or refund the product.
 
You may cancel any order in writing. Click here to contact us.
 
We will invoice you upon receipt of your order. Invoices will include VAT at the prevailing rate and are payable upon receipt except where we have agreed credit terms.
 
Subject to your status we may require payment in advance (pro-forma invoice) before we supply any products. You will be notified in writing by us, in advance, if this is a requirement. 
 
You agree that these terms are subject to the Late Payment of Commercial Debts (Interest) Act 1998 and that we are entitled to interest thereunder on all payments due from you (and in relation to the calculation of which interest any revised payment date shall be regarded as the date on which payment is (or was) due). In the event that you fail to make payment in full of an invoice in accordance with the terms, you acknowledge that we will be entitled to treat the failure to make payment as evidence of your insolvency for the purpose of s123 of the Insolvency Act 1986, and/or to withdraw forthwith and without liability our services in full.
 
In the event of late payment, we reserve the right to suspend your advertising services until such time that we have received payment in full. Thereafter we may change your account to pro-forma invoice for all subsequent orders or decline future orders from you.   
 
Use of job seeker CV database
Where you have been granted access to our CV database of job seekers you will be able to search a database of job seekers who have given permission for their details to be accessed by other employers or recruiters without applying to a job vacancy and contact them directly about employment opportunities.
 
You acknowledge that the database, its content and all rights thereof remain the property of PJD and that by granting you access to the database you do not acquire any rights over the database.
 
By using the database you agree to comply with this code of conduct, the terms, privacy policies and diversity policies of the Web site and not to use the data for any other purpose than contacting job seekers about your job vacancies and own recruitment related activities.
 
We reserve the right to deny you access to the database forthwith for any abuse of this code of conduct, the terms, privacy policies and diversity policies of the Web site.
